Q: For how long is an Employer Sponsor Licence valid?

A Sponsor Licence is usually valid for up to 10 years. If you wish to continue employing foreign workers, you must comply with all Sponsor Duties to maintain your Sponsor Licence at the highest rating (A-rated Licence). Licence Renewal can be done via the Sponsorship Management System (SMS).

Q: My sponsored employee is not following the conditions stipulated in their visa, what can I do?

If your employee is not obeying their visa conditions, it is your responsibility to seek legal advice and report to UKVI within the deadline. Not taking appropriate action may risk your Sponsorship Licence being suspended or revoked.

Q: How can I obtain an Employer Sponsorship Licence?

Businesses must first ensure that you are meeting all of the eligibility requirements, then select which type of licence you need, depending on the nature of worker that will be employed. After ensuring that you have the staff and resources in place to manage your licence, we can process the Sponsor Licence application on the Home Office website.

Q: Can I withdraw a Certificate of Sponsorship?

You may be able to cancel a Certificate of Sponsorship that has been assigned but not yet used to support a Visa application. This can usually be done through your SMS account. The Home Office may also decide to cancel a certificate if the correct fee has not been paid in full or if certain procedures are not adhered to. Please note that you may not always receive a full refund when cancelling a certificate, depending on the timing and circumstances. We can advise further on whether it would be more sensible to amend or withdraw a CoS.

Q: What happens to my licence if I get more than 2 B-ratings?

You can only have 2 B-ratings during the validity of your Sponsor Licence. You may lose your licence if you still need to make improvements after your second action plan. You may also be barred from applying for a new licence for up to 12 months. This is why it is key to consult with Immigration professionals and ensure that everything on your action plan is properly accounted for.
